|
|
|
Regarding the class-action overtime lawsuit on behalf of current and former DG store managers, and their misclassification as exempt employees:
More good news!!
I found the name of the law firm handling the case in a news article, and sent them an e-mail inquiring as to how to "opt-in" to the suit. I got a letter yesterday from Ramon A Shaul, one of the attorneys with Beasley, Allen, Crow, Methvin, Portis & Miles, P.C., along with the forms to fill out and send back in. I did that, and now I'm signed up and part of the suit. It's as easy as that!
DG has already been ordered by the court to produce a list of names of all store managers from March 14, 1999 to Jan. 12, 2004, and as soon as the law firm has them they will send out letters to all those on the list. Until then, you can notify the law firm that you want to opt-in through their website and "beat the rush". The deadline for “opting in” is May 31, 2004, so don’t waste any time!
All eligible former and current DG store managers who wish to sign up now can do so by contacting the law firm via e-mail through their website and simply asking to join up.
Here's their website address:
http://www.beasleyallen.com
When you get to the website, click the “Contact Us” icon located in the brown bar at the top of the page, just under the firm’s name. Fill in your name, address, etc in the template and then type in a request to join the lawsuit in the “Comments” box and click “submit”. It gets sent from there.
They’ll send you a set of forms to fill out & return. After “investigating” your eligibility, (in other words, verifying that you are or were employed by DG as a store manager), they will file your papers with the court and -- you’re in! The investigation of your claim could take up to 90 days, so be patient after you send the forms in.
It would be better to send the e-mail from their site or a regular letter, since they may get nothing done but answering the phones if everyone calls. Their mailing address is:
Beasley, Allen, Crow, Methvin, Portis & Miles, P.C.
Attorneys at Law
Post Office Box 4160
Montgomery, AL 36103-4160
(If you -- or someone you know -- really needs to call instead of using the website, the number is: 1-800-898-2034.)
Be sure to click on the “Top Story” on the firm’s website (just under the brown bar on the Homepage) -- it’s all about this lawsuit. There are 40 people signed up so far, we can make that number multiply faster than you can say “Recovery!!” or “Door to floor in 24!!”
So, whether you choose e-mail, snail mail, or telephone -- contact them and sign up now!!
The more the merrier!!! The lawyers are waiting to hear from you!
P.S.: There is absolutely no cost to you for signing up! All expenses for handling this case are paid out by the firm, and they get paid back out of any judgement that may be levied against Dollar General. Even the return envelope for sending in your forms has the postage already paid for. There's no reason not to sign up, and every reason to jump on the bandwagon without delay. Also, be sure to spread the word on this to any past or present store managers who may not be aware of it.

I took the liberty of making this a "sticky".

They can't retaliate against you for being part of that lawsuit. If they do, then they can be sued even further.

USA is right, that's another lawsuit that they'd probably lose - in 2010 or so. What about the years in between?

has anyone seen the dollar general annual report that was put out in the mail. It has talked about the law suit and mentioned that it might have to have cash pay outs.
Don't forget that May 21st is the date that the paper work to the lawyers has to be in.
