A Best Buy manager was fired,when applying for new jobs he found out that his old employer/hr told Target he 'sucked'.He sued,ex employer not supposed to interfere with an ex employee procuring a new job.
Brings up several issues as noted on the posts.
1)how much should a new employer be told-how should a potential employer find out you really might of 'sucked'.Does it matter since a new company/fresh start.Which brings up the 2 nd issue 2) how does a applicant/ex employee protect themselves from a bad manager or one with a grudge.Things can get personal and priorities mis-placed.How does a employees get out of a bad situation/relationship-would you rather see ex employees on the tax payers dime or should they get a chance to escape a bad situation and start over.Bad relationship happen,people quit.
An hr poster noted it best just for both parties to move on which is the law in most cases-just give minimum information to confirm accuracy.
But if this person applied for management at another company should they require more than "yes he worked here etc" reference.In effect when asking for management you literally asking for the keys to store.But then again-unless he 'sucked' because of criminal activity wouldn't a probationary period weed out those who 'sucked'.

What I'd like to know is how the employee found out they said he sucked. I can't imagine the new employer telling him something like that.

Apparently he wasn't getting any responses to his applications/resumes and became supicious.He sent an e-mail to his old employer pretending to be a new employer checking on up on him.Got an e-mail response saying he sucked.

Though not typical practice, it should be the employee's right to know anything that was said negative IMHO.

I agree, but in many states, it's illegal for the old employer to give info beyond a certain level and also illegal for the new employer to solicit or consider such info, so I doubt that they'd tell you about it.

That's worth checking into. In some states, it would be grounds for a lawsuit and/or downright illegal.[/quote]

I think his problem is that he asking for a management job in where the new employer is asking for more than dates in a reference.As long as they can verify he was a manager they should just use a very strict probationary period for those asking to start out as a manager.
Perhaps this guy would better just applying entry level THEN apply to management once he has his feet wet in the new company.I doubt an entry level app would mandate personal references.Many companies make you start out at the bottom anyway if you are bringing degrees,certifications,licenses etc.
